Welcome to MetroMiix. These Terms of Service (“Terms”) govern your access to and use of our website (metromiix.com), services, and all related offerings (collectively, the “Services”). By accessing or using our Services, you agree to be bound by these Terms. If you do not agree, please do not use our Services.

1. Use of Our Services

You must be at least 18 years old to use our Services. By using our Services, you represent that you meet this age requirement. You agree to use our Services only for lawful purposes and in compliance with these Terms. We reserve the right to suspend or terminate your access for any violation.

2. Products and Orders

All product descriptions, images, and specifications are for illustrative purposes only. We strive for accuracy but reserve the right to correct errors or update information without notice. Orders are not binding until confirmed. We may cancel orders due to pricing errors, unavailability, or other issues.

3. Pricing and Payment

All prices are in USD and exclude taxes, shipping, or fees (displayed at checkout). We accept major credit cards, PayPal, Apple Pay, Google Pay, and Affirm financing. Payment is processed at order confirmation. You authorize us to charge your payment method and may be charged for failed payments.

4. Shipping and Delivery

We offer free freight shipping to all US states (excluding APO/FPO). Delivery times are estimates only (typically 3-7 days after processing). Risk of loss transfers upon delivery to the carrier. We are not liable for shipping delays, lost packages, or carrier errors.

5. Returns, Exchanges, and Refunds

Our 30-day return policy applies to unused products in original condition/packaging. See our Returns & Exchanges policy for details. We cover returns for defects or shipping errors. Refunds process within 3-7 business days of inspection. Shipping fees are non-refundable except for our errors.

6. Warranty and Liability

Products carry manufacturer limited warranties (1-5 years). See our Warranty Program for details. TO THE FULLEST EXTENT PERMITTED BY LAW, METROMIIX DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. Our liability is limited to the purchase price. We are not responsible for misuse, improper installation, or normal wear.

7. Limitation of Liability

IN NO EVENT SHALL METROMIIX BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS. Our total liability shall not exceed the amount paid by you for the product(s) in question.

8. Intellectual Property

All content, logos, and materials on our Services are owned by MetroMiix or our licensors and protected by copyright, trademark, and other laws. You may not reproduce, distribute, or create derivative works without written permission.

9. User Content

By submitting reviews, comments, or other content, you grant us a perpetual, royalty-free license to use, modify, and display it. You represent that your content does not infringe third-party rights and complies with our guidelines.

10. Prohibited Conduct

You agree not to: (a) use our Services for illegal purposes; (b) interfere with our site or servers; (c) attempt to gain unauthorized access; (d) post harmful, defamatory, or fraudulent content; or (e) impersonate others.

12. Governing Law and Disputes

These Terms are governed by Colorado law. Any disputes shall be resolved exclusively in the state or federal courts located in Denver County, Colorado. You waive any objections to venue or jurisdiction.
